General Information
These Terms and Conditions govern all contracts entered into with Toddlekind GmbH unless otherwise agreed in writing. Your own terms and conditions do not apply unless explicitly accepted by us.
Please read these terms carefully before placing your order. They explain who we are, how we provide our products, your rights, what to do if there is an issue, and other important details.

When we refer to “writing” in these terms, this includes emails.
2. Forming a Contract
Our product pages are an invitation to order, not a binding offer. When you press the final order button at checkout, you make a binding offer to buy. The contract is formed when we email your order confirmation.
If we cannot accept your order, we will notify you and no charge will be made. Reasons may include product unavailability, pricing errors, or delivery limitations.
Each order receives a unique order number, please reference this in any communication with us.
3. Prices and Payment
All prices listed on our website include statutory VAT.
Any applicable delivery costs are displayed at checkout before purchase completion.
We accept major credit cards, PayPal, Klarna, and other secure payment methods as shown at checkout.
Payment is due immediately upon order submission.
4. Governing Law and Jurisdiction
German law applies unless it deprives consumers of the protection granted by their country of residence under EU law.
For business customers, the place of jurisdiction is our registered business location.
The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
5. Product Information
Product images are for illustrative purposes only. Colors may differ slightly due to device or monitor settings.
Sizes, weights, and dimensions have a tolerance of ± 5%.
Packaging may vary from images shown.
6. Liability
We accept unlimited liability for harm to life, body, or health caused by negligence or intent.
For other damages, we are liable only for foreseeable losses resulting from a breach of essential contractual duties.
We are not liable for minor breaches of non-essential duties.
We cannot guarantee uninterrupted access to our website due to technological limitations.
7. Delivery
Delivery costs are displayed during checkout unless otherwise noted.
You will receive order and delivery details via email. Please ensure your email address is entered correctly and can receive messages from us.
We are not liable for delays outside of our control. If you are not available to accept delivery, the courier will leave instructions for re-delivery or collection.
Failure to collect or rearrange delivery may result in additional storage or delivery charges.
Risk of loss or damage passes to you only once the goods are delivered to you or a person authorized to receive them.
Ownership of the goods passes to you once full payment has been received.
Free gifts or promotional items must be returned if the associated order is returned.
8. Right of Withdrawal (EU Consumers Only)

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.
To exercise the right of withdrawal, you must inform us (Toddlekind GmbH, Rodenbacher Straße 3A, 63579 Freigericht, Germany, telephone +49 (0) 6055 883 8000, email hello@toddlekind.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. You can also exercise your right of withdrawal online at https://toddlekind.eu/pages/return-form. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods. For the Nook Sofa, which cannot be returned by parcel, the cost is estimated at a maximum of approximately 12 EUR per Nook.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Use of Personal Data
We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and German data-protection laws.
We use your data to, among other purposes described in our Privacy Policy:
- Process and deliver your order
- Manage payment transactions
- Communicate with you about your purchase or, with your consent, send marketing updates
We share data with service providers as described in our Privacy Policy, or when legally required.

10. Dispute Resolution
Toddlekind GmbH is not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
